Hello and Welcome to ADA Services.

ADA Services was founded by a business and property owner just like you. Now we’re not sure where you are at in this ADA minefield but our founder thought his business and property was fully compliant with ADA laws. He found out through “education by litigation” that it clearly was not. Once notified of the legal action the first call was to his attorney. The call went exactly like this.

Our Founder: This can’t be right, I recently pulled a permit and they made me do ADA upgrades. They signed off on everything. I must be in compliance right?

Attorney: No, the upgraded items may be in compliance now but there are literally 100s if not 1000s of other items that may not be in compliance. Here’s the kicker. If there are items out of compliance you are guilty with almost no chance of defense and could be liable for up to $4000.00 per item not in compliance. At this point your only option is to settle (pay him off) with this guy suing you.

This settlement ended up costing our founder over $27,000.00 between court costs, attorneys fees (on both sides!) and the required inspection and upgrades. Believe it or not this was getting off easy! It would have cost much much more if it actually went to trial.

Through this process our founder couldn’t believe this was actually happening. Why has no one ever informed him of these potential ADA hurdles? He was forced to learn everything possible about ADA laws and regulations. He also learned that the ADA laws are very confusing and hard to understand. He learned that these attorneys and people suing are actually in the right (like it or not). These laws have been in place since the early 1990s and there are no exceptions.

Our founder realized he needed a plan to insure this would never happen again to this facility or any of his others. He needed to be proactive rather than reactive. He searched for companies that could create an ADA Action Plan. He was surprised to find there weren’t any. There are companies out there that will do a basic ADA inspection. Their inspections were very expensive and not designed to be proactive. Also, the inspection is just part of the puzzle. Once you get the inspection what do you do with it? What items have to be done? When should they be done? Do they have to be done? What other things can I do to stay complaint? No one had these answers.
